Canadian Warranty

1. Crown Tanks of Canada, Ltd. ("Crown") hereby guarantees the domestic heating oil oval tanks manufactured by to be free from defects in material and workmanship under normal service and will furnish a new tank, without charge, within ten (10) years on Bottom Feed tanks and five (5) years on End Feed tanks, from the date of its original installation if proved to its satisfaction to be defective in material or workmanship.

2. this warranty shall not be effective:

• unless said tank is properly installed in accordance with NFPA 31, state and local fire 
• codes, the National Board of Fire Underwriters and within the U.L.C specifications for 

  installation.*
• if leak or other defect is caused by damage to tank, or because of fire, floods, lightning or 

  any act of God.
• if upon examination by Crown's representative, the leak or any other defect can be adjusted 

  without replacing the tank.
• if oil is transferred from old tank into new tank at any time.

3. in the event a tank must be replaced, Crown will give the wholesaler 2 tanks to replace the 1 tank that leaked. the second tank is to compensate for the labour involved in removing the tank. Crown will not pay any labour bills associated with tank replacement.

*ALL TANKS MUST BE TESTED AT JOBSITE

The UL code 80 & 142 & ULC S602, which cover basement and aboveground tanks for flammable and combustible liquids, state that these tanks are "for installation and use in accordance with the standard for installation of Oil-burning Equipment."  The National Fire Protection Association specifies under NFPA 31 [1997 Edition], paragraph 2-1.4.3 that each tank and its piping must be tested before being put into service by the installer.

Crown tests all tanks during the production process.  Crown will not accept responsibility for tanks that have been improperly tested at the jobsite or have been improperly installed.

This warranty shall be the only obligation of Crown with respects to the said tank, and is in lieu of all other warranties or representations, expressed or implies, and Crown. shall have no other liability hereunder, either direct or contingent, for damages to person or property, nor shall Crown be bound by any representation or undertaking made by other persons whether or not purporting to be authorized to act on its behalf.  There are no warranties of merchantability and there are no warranties, which extend beyond the description on the face hereof.  This warranty is not transferable unless its duly authorized representative endorses Crown's prior consent.  By acceptance of this certificate, the purchaser and any authorized transferee agree to the conditions and provisions hereinabove set forth.

ALL INSTALLERS AND CUSTOMERS SHOULD BE MADE AWARE OF THIS WARRANTY.
